The Egyptian Association for Community Participation Enhancement (EACPE) wrapped up the second annual conference of the state of democracy in Egypt, which was titled "how elections can become a mechanism for peaceful transfer of power in Egypt" on Sunday and Monday 4 and 5 July 2010, held at Safir Hotel at Dokki.. The second day of the conference began with the first session entitled "Electoral System and Quota" chaired by Professor Farida El Naqqash Chairwoman of the Forum for Women's Development, which began the meeting with a historical review of the quota system for women in Parliament to achieve genuine representation of women, at which Mr.. The Egyptian Association for Community Participation Enhancement (EACPE) holds the second annual conference of the state of democracy in Egypt under the title "How elections can become a mechanism for peaceful transfer of power in Egypt" being held on two days starting Sunday the 4th of July.. The conference launched with an opening session that started with Dr.. Magdy Abdel Hamid's Head of broad, word in which he talked about the importance of the title of the conference and that this title is a continuation to the Democracy Status Report for the year 2009 in which the association concluded that the elections in Egypt is not a mechanism for peaceful transfer of power.. Dr.. Amr El Shoubaky took the floor and talked about the current political scene and the new political movements and the struggle of some of them to present a real alternative and mechanisms to convince the public.. He also talked about the experience of the inner elections of the old parties and the emergence of new trends and forces in the democratic movement and the absence of a formula for the interaction between these forces that Almost tends to be a break between them, with the exception of the Democratic front and Wafd Party in its recent elections experience, what he called the second wave of political progress in Egypt, the emergence of the call of El Baradei to amend the constitution and stressed that the Muslim Brotherhood are, as usual and for more than 80 years ,out of the frame of the new political landscape after Mubarak.. The second session which was chaired by Mr.. Bahy El Deen Hassan, director of Cairo Institute for Human Rights and its title was "The nature of the political system and the electoral status", started with the paper presented by Mr.. Ahmed Fawzy, Director of the democracy development program at the (EACPE).. Mr.. Ahmed started his talk with the legal and legislative structure and mentioned that the problem with elections in Egypt lies in that the legislations governing the elections are entangled with the legislative crisis in its reference and the way its issued since the constitution is a guardian for liberties and also the legislative council does not include enough legislative cadres to issue legislations that replay to the public's demands.. He also points out the intervention of the administrative institution in every election alongside the fact that the constitution didn t clearly state the nature of the elections whether it depends on relative lists or individuals furthermore, he reviewed the most prominent problems of the law on political rights which has been issued in the absence of a multi-party and therefore the philosophy of this law was based on the absence of multi-party system, as regards to the formation of the Supreme Committee for Elections, there are a lot of negativity concerning the method of selection of its members and the powers of the Commission as well as the multiplicity of laws governing a single election.. Also there is no text of the law provides that the success of any party to give it the right to form the government or participating in its formation, as well as there are many laws that ravage the public freedoms such as the law sanctions and restrictions, not to mention exceptional laws.. Then the floor was given to Dr.. Ibrahim El Essawy, economics expert, who talked about the economic and social environment and its influence over the Egyptian elections in which he confirmed that the elections are an element of democracy like freedom of gathering and freedom of opinion and expression and that the final effect of the results of the elections doesn t stop at the effect of the economic and social environment nor on the cultural environment only but it ends at the interaction of these environments which means that the possibility of power mobility is governed by the relations of economic and social forces hence the concentration of wealth is what entails the concentration of power and he gave examples of the experience of democracy in India, Latin America and their electoral lists systems, so as to eliminate the role of money in elections and stop the direct fraud and election bribes, and stressed that the lack of mature social environment led to the immaturity of the democratic experiment, As for the situation in Egypt, high rates of poverty and decline in the level of awareness  ...   trigger the victory of the National Party candidates, except in the eighties when the labor Party won in ten constituencies and then came the election system of individual and security control which we can say that Elections are devoted to the ruling party's grip on localities and what is needed is to have the right of People's Councils to challenge the decisions of the Executive Boards and have more access to power.. The Egyptian Association for Community Participation Enhancement, coordinator of the coalition of CEDAW in Egypt, has organized within a project to Strengthen CEDAW Egyptian NGOs Coalition to enhance the use of International Regional Mechanisms to Enforce Women s Rights , a Conference for two days on 29 and 30 May.. The conference's topics came from the most vital issues and priorities that emerged after writing a shadow report and presenting it to the United Nations CEDAW Committee last January.. On the first day three topics were tackled; (what is after the recommendations of the Geneva Committee - Women and judiciary - the political participation of women and the quota) and, on the second day there was a focus on the role of the legislature in the face of violence against women and the role of civil society and associations and Media programs in the face of all forms of violence against women.. On The first day, Dr.. Ferkhunda Hassan, general secretary of the National Council for Women, talked about the perception of forms of cooperation between civil society representatives in the associations and the National Council for Women as a national mechanism to implement CEDAW and to improve the situation of women in Egypt.. Afaf Marei, coordinator of CEDAW in Egypt, spoke about the Role of NGOs in the process of writing the shadow report about the conditions of women in Egypt and also confirmed that there are enlightened Islamic researches which confirmed the equality of men and women upon divorce.. Therefore, Article 16 does not contradict Islamic Sharia, which thus requires that Egypt must eliminate reservation on it, and review the rest of its constitutional reservations, she also presented the concluding observation of the CEDAW Committee to the Egyptian government, highlighting that there should be cooperation between government, NCW and civil society in order to implement the recommendations especially with the presence of alarming issues as sexual harassment, violence against women in the family, and amending the family laws.. Siham Negem, director of Women and Society Association, said that there are priorities for women's issues in Egypt, which had been presented to the CEDAW committee; these priorities are: violence against women, political participation and personal status Law.. On the second day , Tahany el Jabali Vice-President of the Supreme Constitutional Court and the first women judge , said that the right of women to become judges is a right that shouldn t even be discussed and that mere discussion is a backward step, and that there is a difference between judiciary independence and the independence with judiciary ,.. Ashraf el Baroudi, deputy of Cairo Court of Appeal said that the right of women to work as a judge is settled , and added that the working conditions in the courts, are the same administrative conditions faced by judges being man or woman in need to reform and not because they are women they should be excluded but because they suffer from the same difficulties faced by male judges and that women's right in the judiciary is not just in their favor, but for the benefit of the whole of Egypt, he also added that we are behind in the overall context and that this issue is one of the highlights of our backwardness.. Khalid Ali as a lawyer and Director of the Egyptian Center for Economic and Social Rights added through a thorough research paper on women's right from reality and the perspective of the law and the historical references behind the notion of women working and the right to participate in all leading positions and all aspects of work, that the issue of women judges at the State Council is a falling symbol, where as the people who were presenting themselves all the time as symbols of freedom are now mere actors, and that the General Assembly  ...   violence and, saying that her association had received about 68 cases of violence through 2009.. Events of midterm elections for the Shura Council extension of Emergency Law Lawyers syndicate events the Supreme Administrative Court rules for marriage of divorced Christians these are the subjects that the 16th Democracy Status Report have monitored for the month of May, issued by the Egyptian Association for Community Participation Enhancement under the umbrella of its project "Towards building new Democratic Spaces" for the period from the 1st of May to the 31st of May.. The report has monitored the events of the midterm elections of the Shura Council which procures began since the 5th of May with the decision to open the door for nomination, the electoral publicity stage and ending with the elections day.. This election assured that the Egyptian Electoral process is very far from the free and fair electoral international standards.. There is a legislative frame that does not secure total equality between the all the parties of the electoral process since the legislations organizing the working of the Shura Council didn t put into consideration the legislative rights that the latest constitutional amendments have granted it; and remained with the legislative frame that rules its work per as a consultative council.. Thus, it kept for the President the right to appoint one third of its members and the elections is still held by the un-understandable lot system that excludes half of the constituencies from going through the elections..
