Descriptive info: Magrabi.. Net.. > بيانات, الأنتخابات البرلمانية >.. Press Release on the verdicts issued by Administrative Courts.. 26-11-2010, 16:06.. Author:.. nabil.. The Supreme Administrative Court issues a verdict obliging the Supreme Committee for Elections to implement the State Council's rulings.. Press Release.. 26 November 2010.. The Supreme Administrative Court, headed by Counselor Magdy Al-Agattym, issued a final and irrevocable verdict, obliging the Supreme Committee for Elections to implement the judicial rulings regarding accepting the documents of some candidates for the People's Assembly.. The rulings were challenged by the Administrative bodies before incompetent courts.. The draft verdict stated that the Supreme Committee for Elections should be neutral and independent while supervising the elections, and to perform its duties in accordance to the constitution and laws.. The Court affirmed that the Supreme Committee for Elections shall not consider the challenges filed by the Executive power before incompetent civil courts and Courts of Summary Procedures.. These challenges have no legal consequences as they were filed before incompetent courts and are not in accordance with the principles of the Supreme Constitutional Court.. The Supreme Administrative Court stated that the Supreme Committee for Elections shall not be an obstacle in applying the law, and should consider the challenges as null and void.. The Egyptian Association for Community Participation Enhancement (EACPE), a member of the Independent Coalition for Elections Observation, praises this historic verdict issued by the Supreme Administrative  ...   lawsuits filed by candidates regarding halting the elections for not enlisting their names in the electoral lists, which resulted in the annulment of the electoral process.. In Qaliuobeya Governorate, the Administrative Court of Qaliuobeya cancelled the elections in 4 constituencies: Toukh, Banha, Kafr Shokr and Shubra Al-Khaima (second constituency).. In Behira Governorate, the Administrative Court of Alexandria ruled for cancelling the elections in 5 constituencies: Rashif and Idko, Mahmoudeya, Rahmaneya, Shubrakhit and Itay Al-Baroud.. In Assuit Governorate, the Administrative Court ruled for cancelling the elections in the first constituency of Assuit, located in Bandar Assuit.. In Kafr Al-Sheikh Governorate, the Administrative Court of Kafr Al-Sheikh ruled for cancelling the elections in all constituencies of the governorate, including both Quota Seats.. In Dakahleya Governorate, the Administrative Court in Mansoura ruled for cancelling the elections in 10 constituencies: Miniat Al Nasr, Dekernes, Al-Manzalah, Markaz Al Mansoura, Sherbeen, Bani Obaid, Gamaleya, Aga, Belqas and Bassandila.. The insistence of the Executive Authority to not implement the aforementioned verdicts of the Supreme Administrative Court and other administrative courts, and the absence of the Supreme Committee for Elections proves that the Administrative and Security intervention in the electoral process makes it almost impossible to run free and fair elections according to international standards, and makes the elections susceptible to annulment.. Descriptive info: The Supreme Committee for Elections refuses issuing monitoring permissions to EACPE for security reasons.. 25-11-2010, 11:36.. The Security is the official sponsor for the Supreme Committee for Elections.. CSOs representatives face insult and libel by security personnel.. Cairo, 25th of November 2010.. The Supreme Committee for Elections refuses issuing monitoring permissions to the Egyptian Association for Community Participation Enhancement (EACPE), a member of the Independent Coalition for Legislative Election Observation.. EACPE's representative, as well as other representatives of Civil Society Organizations (CSOs), faced humiliating treatment including verbal assault and libel.. EACPE's representative was informed by security personnel that EACPE was rejected for "security reasons".. When the representative requested meeting one of the Supreme Committee's counselors, a security member replied: "I am the Supreme Committee for Elections, I issue permissions for whoever I desire, and I reject whoever I desire", then EACPE's representative was expelled in a very humiliating  ...   of the counselors, who are members of the Committee, or civil employees.. Security personnel humiliated and insulted candidates and representatives of CSOs and also prevented them from accessing the HQ of the Supreme Committee for Elections more than once.. The Supreme Committee's decision, of not issuing monitoring permissions for serious and independent CSOs, proves what we have already mentioned in our previous reports that the Supreme Committee for Elections is not independent or neutral and is subject to the dominance and ascendancy of security and administrative entities.. EACPE states that this rejection, as well as the arbitrary practice of security personnel, shall not prevent it from monitoring and observing the elections; as EACPE's legitimacy is derived from its credibility.. Furthermore, EACPE affirms that monitoring the Elections by CSOs has its legitimacy in the constitution, laws, international agreements and treaties as well as court verdicts that guarantee this right..

  • Title: EACPE filed an appeal against the head of Supreme Committee for Elections » The Egyptian Association For Community Participation Enhancement
Descriptive info: 30.. EACPE filed an appeal against the head of Supreme Committee for Elections.. 22-11-2010, 15:32.. : 996 |.. 22 November 2010.. The Egyptian Association for Community Participation Enhancement (EACPE), a member of the Independent Coalition for Elections Observation, filed an appeal No.. 7072/65 J before the "first constituency for individuals".. The appeal was filed against the head of Supreme Committee for Elections due to the fact that he abstained from implementing the passive decision of granting monitoring permissions for the Legislative Elections 2010 for EACPE.. The appeal also challenged Res.. 57/2010 regulating the issuance of election-monitoring permissions for Egyptian Civil Society Organizations (CSOs), as this resolution confines the monitoring process to only the voting and counting processes but EACPE demands that this resolution becomes absolute and allows monitoring to all phases of the electoral process.. EACPE has submitted a request to the Supreme Committee for Elections on 1/11/2010, requesting the issuance of 967 permissions for EACPE's observers.. Attached to this request were all the needed documents by the Committee.. Until the filing date of the appeal, the Committee abstained from handing the permissions to EACPE and other CSOs.. Statements of the Supreme Committee for Elections, announced by the official spokesperson, counselor Sameh Al-Kashef, were negative regarding the jurisdiction of CSOs in monitoring the electoral process.. The Committee determined in its decision the date on which attachments should be sent by CSOs, but did not mention the date on which CSOs should receive the permissions.. The committee also put loose and inaccurate conditions such as good behavior and neutrality despite the fact that there are no mechanisms through which the Committee can make sure that these conditions are met by the CSOs.. This means that the Supreme Committee for Elections will have to recourse to administrative and security entities to make sure these conditions are met.. Resorting to administrative and security could repeat the same scenario of the Midterm Elections for the Shura Council 2010, in which independent and neutral CSOs were excluded from the monitoring process.. • Title: Press release EACPE Issued The First Report on Campaigns of the Candidates for the Legislative Elections » The Egyptian Association For Community Participation Enhancement
Descriptive info: Press release EACPE Issued The First Report on Campaigns of the Candidates for the Legislative Elections.. 21-11-2010, 15:24.. : 619 |.. Press release.. 21 November 2010.. The Egyptian Association for Community Participation Enhancement (EACPE), a member of the Independent Coalition for Elections Observation, issued a report on campaigning works done by the Legislative Elections 2010 candidates.. The report included the two decrees, 56 and 58 for the year 2010, issued by the Supreme Committee for Elections; the main remarks noticed by EACPE's field observers are as follows:.. Neither the Supreme Committee for Elections (SCE) nor the Ministry of Interiors, which supervises the registration phase, published the names of candidates in two daily and widely distributed, newspapers as per the stipulations of article 9 of Law no.. 38/1972 regarding People's Assembly.. This is due to the fact that administrative courts in different governorates have issued verdicts inserting some candidates, whose documents were rejected by the Ministry of Interiors, or were not registered in the final lists.. Security Directorates dodged implementing the aforementioned administrative courts' verdicts through the Ministry of Interiors challenging the verdicts before incompetent courts to stop implementing them.. These verdicts cannot be stopped from being implemented through challenging before the Supreme Administrative Court.. Some of the governorates that abstained from implementing the verdicts are 6th of October, Alexandria, Dakahleya, Monufey, Minia and Kafr Al-Sheikh.. There was contradiction between the Supreme Committee for Elections' decrees regarding implementing the administrative courts' verdicts.. At first, the committee stated it would implement all verdicts regarding inserting candidates' names in the final lists.. Later on, it announced in newspapers issued on 20/11/2010 that it would insert names of candidates who have court verdicts and have no legal obstacles preventing the implementation.. The main legal obstacle, according to the Supreme Committee for Elections, is having these verdicts challenged.. The Committee announced it would not implement challenged verdicts.. Most of the candidates, whether independent or belonging to the National Democratic Party (NDP), Muslim Brotherhood or opposition parties, have violated the decrees and regulation issued by the Supreme Committee for Elections regarding the maximum limit of spending, using religious slogans and institutions, state-owned funds,  ...   coming Legislative Elections is the intense conflict between different "wings" of the NDP.. That was crystal clear in the mutual violence, libel and slander between NDP candidates in different constituencies, as well as the absence of banners that include the two candidates of the Labor and the Professional seats in the same constituency.. The report includes the observations of the Coalition's field observers for campaigning in a number of constituencies.. 15-12-2010 / 08:35.. Elemental Precision.. Descriptive info: The Fifth Statement On The Fourth Day Of The Opening For The Candidacy Phase (Registration).. 8-11-2010, 12:13.. : 763 |.. On The Fifth Day Of The Opening For candidacy Phase (Registration).. The Independent Coalition's observer s team headed to monitor the elections in 19 governorates in their security directorates to monitor the fifth and last day of the stage of nomination door of the legislative elections that is set to be held on the 28th of November 2010.. The Coalition issued daily statements on the stage of the opening of nomination door and shortly will issue a detailed analytical report about the whole phase.. The following are the notes of the Coalition's team about the fifth and last day of the stage of the opening For The cadidacy:.. The security directorates in different governorates have shown their bias to those presenting their nomination papers and belong to the ruling NDP.. , where it imposed security cordon over the directorate since 3:00pm and prevented those wishing to nominate from reaching the nomination headquarters to present their papers in the governorates: Monofya, Menya, Qena, El Behira and El Gharbia.. On the other hand, it allowed those wishing to nominate from the NDP to enter from 3:00pm to 6:30pm which is a direct violation to the Minister of Interior's decision that set the last date to accept the papers at 5:00pm Sunday the 7th of November 2010.. Also, some directorates have set certain rooms for the NDP secretaries as what happened in the security directorates of: Cairo, Giza and Helwan.. The increase in the security intervention at the closing of the stage.. , as Mr.. Mahmoud Senousy who was supposed to present his papers (worker- independent- Bandr El Menya) has filed a complaint to the Coalition, stating that he was held from 3:00pm until 5:30pm inside the headquarter of the directorate and he was not allowed to present  ...   party in Suez and so the security forces has closed the streets leading to the headquarters of the NDP in the governorate and three of the demonstrators were arrested.. In Luxor, and after the announcement of the results of the NDP Electoral College and the choice of Wael Zakaria (professionals Isna), there has been altercations between his supports and the supports of his opponent that ended with the police forces intervention.. Female candidates in the last day of the stage of opening the elections door:.. the dominant feature was the facilitating the procedures of accepting their nomination papers in the governorates, with the exception of Mrs.. Iman Ramsy Faheem (professionals- independent- El Behira Quota seats) who couldn t present her papers and went to the Supreme Committee for Elections , but she was expelled and humiliated despite her dependency on the appeal 988 for the 1965 of the Administrative Judicial Court in Cairo, with a case similar to hers.. In Giza, Mrs.. Soaad Abdel Salam (professionals- independent quota) was incapable of presenting her papers, since after the responsible employee has received her papers, it was given back to her for no reason what so ever.. She headed to Giza Judicial complex to file a law suit.. In Cairo, Mrs.. Gamila Ismail headed to Cairo's security directorate to present her papers on (quota south Cairo- independent- professionals), and also on Qasr El Nile constituency on regular seat independent professionals and her justification is that the law doesn't prevent her from applying to two quota seat and regular seat, which led to the confuse of the committee of accepting papers and then it was clarified that she can't apply to two different constituencies and finally she applied on (Qasr El Nile seat- professionals- independent), she stayed for a long time in Cairo's security directorate and refused to leave before knowing her electoral sign and receiving her electoral card..

  • Title: The legislative elections 2010 Observations of the Independent Coalition About the stage of opening the nomination door November 2010 » The Egyptian Association For Community Participation Enhancement
Descriptive info: The legislative elections 2010 Observations of the Independent Coalition About the stage of opening the nomination door November 2010.. 7-11-2010, 14:20.. : 748 |.. The legislative elections 2010.. Observations of the Independent Coalition.. About the stage of opening the nomination door.. November 2010.. About the Coalition and its work mechanism:.. The Independent Coalition for monitoring the Elections includes three Rights Organizations: The Egyptian Association for Community Participation Enhancement, Cairo Institute for Human Rights Studies and Nazra Association for Feminist Studies.. The EACPE is concerned with field observation of all the stages of the electoral process, CIHRS is concerned with monitoring the visual and written media and Nazra is concerned with monitoring gender and women voters and candidates on regular and quota seats.. The Independent Coalition announces its observations about the stage of opening the nomination door, which the Minister of Interior has declared in the period from (3-7 November 2010).. First:.. by the law 38 of the year 1972 about the parliament revised by the law 175 of the year 2005, the Minister of Interior is allowed to issue the decision of opening the nomination door and specify the required documents to prove that the conditions are established and form the committees to check in the applications and make their decisions; and issue decisions by the force of the law related to managing the electoral process, which makes the security bodies ahead of the situation in managing this stage.. It also makes the Ministry of Interior the first responsible for the opening of the nomination stage in a complete absence of the Supreme Committee which is lost in its limited powers given by the law 17 for the year 2008 that gave it the role of supervising the electoral process.. The provisions of the law 38 for the year 1972 gave space to the administrative and security interventions of the executive power in managing the electoral process.. Second:.. the Minister of Interior issued his decision 2126 for the year with the opening of the nomination stage without specifying the required papers and documents needed to prove the status of the nominee, which led to a chaos and stumbling and the non existence of decisions or administrative instructions for  ...   administrative bodies of the executive power has performed acts of intransigence against them and refused to accept their nomination papers without a legal document, whereas those wishing to nominate from the opposition and the Muslim Brotherhood, were able to present their papers in the second day of the stage.. Fifth:.. the NDP was late in announcing his list of nominees until the last moment of the opening of the stage of nomination in order to avoid split inside the party and to close the door in front of those who were not part of the party's Electoral College.. Sixth:.. the prevention of the Independent Coalition's observers of monitoring the elections from reaching most security directorates, the observers were also held several times in Cairo's security directorate and El Qalioubia security directorate on the fourth day for the nomination stage and the withdrawal of the ID cards of the observers in Aswan's security directorate in the fourth day and that is due to the refusal of the Minister of Interior responsible for the opening of the nomination stage to the civil society observers in this stage and that is due to the delay of the Supreme Committee in issuing the declarations of the observers of the civil society.. Seventh:.. the general inclination was the acceptance of the papers of the females wishing to nominate on quota seats without harassment noting that the responsible for receiving the nomination papers were unaware with the rules of the quota seats and their believe that any woman wishing to nominate should not on quota seat without a right to nominate on regular seats.. Eighth: amid the chaos that filled the nomination stage, it is expected that surprises would happen during the announcement if the final electoral sheets specially with the indications allowing the security and administrative bodies of the executive power to exclude nominees , as when those wishing to nominate receive misleading receipts for receiving nomination papers and signing decisions not to practice publicity campaigns until the announcement of the final electoral sheets on 14/11/2010, that is followed by the public holidays on 20/11/2010 which would disrupt the removed candidates from appealing in front of the administrative court.. Cairo November 7th 2010..

Descriptive info: The Third Statement On the Third Day of the Opening for Candidacy Phase.. 6-11-2010, 22:41.. : 799 |.. On the Third Day of the Opening for Candidacy Phase.. The team of the Independent Coalition for Election Observation in 19 governorates headed to the security directorates to monitor the third day of the opening for candidacy phase for the parliamentary elections scheduled for November 28, 2010.. The number of candidates applying was minimal on the third day due to the fact that Friday is an official holiday in Egypt, which was an obstacle for the independent candidates who had already applied on the second day and needed to complete their documentation.. For instance, they were unable to go to certain governmental entities or the general federation for laborers or their workplaces to get the needed documents required of them the past day.. Most of the applicants form the Muslim Brotherhood and opposition parties had already submitted their application documents on the first and second days, while the NDP had not submitted a list of its candidates until the third day.. The security presence was heavy in front of the security directorates in various Egyptian governorates.. However, security did not prevent any applicant from accessing the security directorates.. There was persistent lack of organization from the administrative side and an absence of the committees formulated under the umbrella of Law No 38/1972 to examine the application documents and manage the phase of opening for candidacy on behalf of the Ministry of Interiors.. For instance, the timing for accepting the documents highly varied from one directorate to the other, and the security directorates continued to request candidacy documents that were not stipulated by the law or the ministerial decree of opening for candidacy.. One of the members of the coalition was detained in the Cairo Security HQ and was banned from accessing the committees which accepted candidacy applications.. The Observations of the monitors team as follows:.. One of the members of the coalition Hamada Al- Kashef- was detained in the Cairo Security HQ and was banned from accessing the committees which accepted candidacy applications.. The justification given was that there were no instructions from the Ministry of Interiors to allow Observers to enter the committees; hence Mr.. Kashef was detained for almost three hours.. This was recurrent with other observers who are members of the coalition during the third day.. Also two journalists from Al-MAsry Al-Youm and Al-Ahram were detained.. A security cordon was imposed around the Cairo Security Directorate HQ.. 34 Applicants submitted their documents, most prominent of whom was Mrs.. Samira Ahmed (Wafd) from Bab Al-Shaireya.. With regards to the Quota Seats, one woman applied namely Mrs.. Wafaa Al-Tawil (Laborer- Ahrar Party) Southern Cairo.. The Cairo Security Directorate was closed at 1:30 p.. The observers of the coalition noted that Security personnel in civil clothes were seated in the spots allocated for applicants in the constituencies of Dar Al-Salam.. Abdeen, Boulaq, Qasr Al Nile, Al-Sahel, Bab Al-Shaireya, Al Gamaleya and Al-Zaher.. Behaira Security Directorate:.. 221 applicants headed to the Behira Security Directorate.. 50 of whom managed to sumbit their applications and documents while the rest were unable to do so due to the slowness in the administrative procedures and the security intervention.. Mohamed Khaled Salem (Muslim Brotherhood, Abol Matameer constituency) and Mr.. Yasser Abdel Rafea (Muslim Brotherhood, Kafr Al-Dawar constituency) complained that their documents were delayed for the third day in a row due to the fact that the security meddled in their turn to enter the committee to submit their applications.. The committee which receives the applications refused the application documents of Mr.. Moustafa Mohamad Al Gahel (Independent- Peasant- Kafr Al Dawar constituency) although he submitted the required documents, however, they asked him for further documents that were not stipulated by the Law No 38/1972 nor the Ministerial decree, such as family documentation, and documents for the land acquisition of his wife and minor kids.. Dakahlia Security Directorate:.. The number of applicants was minimal.. 39 applicants submitted their documents while Mr.. Moutafa Al Gundy (Wafd- Tamy Al Amdid constituency) could not submit his application documents due to his inability to present his registration document in the electoral lists, although he is the incumbent MP of that constituency.. With regards to the quota seats, each of Ms.. Ibtisam Ahmed Qassem (Socialist Arab Party) and Ms.. Iman Mohamed Aly (Independent) for the Northern Dakahleya constituency submitted their applications.. Around 17 applicants complained to our observers from the slowness  ...   documents, including 2 for the quota seats, namely Ms.. Wafaa Mohamed Rashad (Laborer- independent) and Ms.. Farida Mohamed Abdo (Laborer- Independent).. The committee was closed at 5:00 p.. Yehya Haggag (Laborer- Independent- Saff/Tebbin constituency) were accepted.. The application documents of four applicants were rejected as follows:.. Mahmoud Khafaga Hammad (Laborer- Helwan constituency)- for not presenting his status certification from the Labor Union HQ.. Ahmed Rabee Mahmoud (Etfeeh constituency)- due to the arbitrary practice of the Police Officer of Etfeeh Police Station in extracting the red card for him.. Mostafa Mohamed Tawfiq (Independent- Helwan Constituency) for not presenting his military service certificate and his educational documents.. Abdel Razek Zaky Mohamed (Etfeeh constituency) for not presenting an original copy of his commercial records officially stamped.. Mohamed Diaa Al Tibiti (aka Diaa Al Omda) for Armint Constituency was not accepted for not extracting his labor status certification from the Labor Union HQ in Cairo.. Only 12 applicants submitted their documents on the governorate level including 4 for the Quota Seat.. The committee was closed at 1:45 p.. North Sainai Security Directorate:.. 10 applicants submitted their documents and were all accepted.. Opposition and Brotherhood applicants complained that their documents are not accepted except after meeting the head of the Security there, who asks them about their political and partisan affiliations, the constituency they wish to run for, and the nature of their work.. After this interview, he allows the authorization of their application documents and are accompanied by a security staff member to hand in the application to the head of the committee.. The applicants complained to our observers that the head of the committee was always late until 2:30 p.. Fayoum Governorate:.. Contrary to the first two days, the third day did not have heavy security barricades around the application premises at the Fayoum Security Directorate.. Our observers noted that on this day only three applicants submitted their documents.. The remarks of the observers on the Quota-Seats applicants:.. There were minimal applications for the quota seats on day three, where a total of 19 women applied for Cairo, Giza, Dakahleya, Gharbeya, Qaliyoubeya, Qina and Luxor.. In some governorates, such as Northern Sinai, Helwan, Monofeya and Fayoum, no women applied for the quota seats.. On day 3, three women applied for the general seats in Cairo, namely Ms.. Fatma Ismail (laborer- Independent- Manial Constituency), Ms.. Yousreya Abdel Samee Abdel Barry (Laborer Independent Al- Zaher constituency) and Ms.. Samira Ahmed (Wafd Bab Al Shaireya constituency).. Ms.. Iman Al Bawab (Independent- Quota Seat) applied to the application committee for laborers seats, but she did not have certification for her laborer status, hence she decided to run for the quota seat as non-laborer/professional, but she was rejected as she did not have the required educational documents or workplace letter.. The documents of Ms.. Zeinab Khalil (Laborer- Independent- Quota Seat- Gharebya Governorate) were rejected for not having a letter from work, although she had a certificate proving her electoral status as a laborer and that she works at the city council of Mahalla Al Kobra.. The documents of Ms, Reda Abdel Fattah Al Moazen (Laborer- Independent- Quota Seat- Gharebya Governorate) were rejected for not having her electoral status certification from the general Labor Union HQ in Cairo, although she had that certification from a branch Syndicate for Medical Services from Gharbeya Governorate.. The application committee at Monofeya governorate had summoned Ms.. Mervat Ebeed (Laborer- Independent- Birket Al Sabaa constituency) to provide missing documents (her electoral status certification).. At the Behira governorate, the application committee rejected the documents of Ms.. Iman Ramzy Faheem (Independent- Professional- Quota Seat) as her electoral card was lost.. Iman had previously gone to the police station to extract certificate to enroll in the electoral list and she could not get it although she asserts that she is enlisted in the electoral lists.. So, she applied to the application committee with a court verdict from the Administrative Court of Cairo dated November 2, 2010 for the case number 988/65 judiciary indicating "enlisting in electoral lists does not necessitate the request of applicant, as it is an automatic procedure that the administration should commit to provide for those who fulfill the conditions stated by the Electoral Panel ".. The applicant had appealed again before the Administrative Court of Cairo against her exclusion and her appeal is due to be reviewed Saturday 6th of November 2010.. 02-03-2011 / 11:56.. 79OGFT a href= http://rzzgybsdzznq.. com/ rzzgybsdzznq /a ,.. pjblmxypywdo.. , [link=http://cfsxostvkogm.. com/]cfsxostvkogm[/link], http://adkbygjywniw.. com/..
