EACPE demands the Ministry of Interior to stop these practices and respect the citizens' rights to freely express their opinion and peaceful demonstrations regardless to their intellectual and political affiliations, as peaceful demonstration is a "right" that should be guaranteed and not a "crime".. The prosecutor general ordered the imprisonment of twenty four demonstrators who were arrested during " Al Shura " events for four days for investigations, and a number of charges were directed to them such as; rioting, attacking public officials while practicing their duties, possession of weapons, stealing wireless devices and demonstrating without a permission from the ministry of interior as per by " The New Demonstrations law ".. It is worth mentioning that same charges used to be directed to civilian demonstrators during the rule of "Mubarak ".. Based on that we call for the immediate release of the arrested demonstrators, and we also call for reconsidering "The Demonstrations law" to differentiate between peaceful demonstrations and violent terrorism which is practiced by the factions of political Islam..

The signatory human rights organizations confirm that the anticipated law should be based on creating balance between protecting human rights and fighting terrorism in a way that avoid the gaps in the law "97" for the year "1992", which was declared by the former president "Mubarak" on the 18.. of June 1992.. According to this law many articles in the Penal Law were amended, as well as amendments to the Criminal Law.. , which is one of the worst laws that violate public freedoms and human rights.. For instance, article" 86" which defines terrorism using loose, general and vague expressions and terms such as "threat", "intimidation" and "violating the public order".. Based on that, the law which is supposed to be declared should refer to:.. 1-.. The fair trial criteria which were stipulated in article" 14" of the International Covenant on Civil and Political Rights which Egypt ratified.. And these criteria are as follows:.. -.. Equality before the judicial authority.. Public trials.. Independence, impartiality and specialization of the courts.. Presumption of innocence.. To give the accused person the sufficient time and facilities needed to prepare his/her defense.. The publicity of courts decrees.. Giving the accused person the right to request negation witnesses under the same conditions needed to request the proof witnesses.. The right to ask for a retrial in front of a higher court should be guaranteed.. 2-.. The 2004 Berlin Declaration, which includes many commitments that the state should respect in order to protect human rights while fighting terrorism.. 3-Security Council declaration number "1456"(2003), 11624(2005) and the declarations of the General Assembly 57/219, 58/187, 59/191 which stipulated that fighting  ...   stress that "Anti-Terrorism Law" should include four main points which are:.. First: The new law should tackle all the objective and procedural provisions which are considered a violation of the criminal proceedings law.. Second: The law should include, beside sanctions procedures, the mechanisms which fight terrorism without jeopardizing the commitments of international agreements.. Third: the law should tackle the new patterns (forms) of terroristic acts recently committed nationally and regionally.. Fourth: the law should refer to the new agreements tackling terrorism following the trend of many laws that extend the judicial authority on terrorist acts that happen outside the country, regardless who the criminals are..
